Due to the special powers granted to Wakf Boards, lack of administrative accountability, and absence of transparency, numerous legal and social issues have emerged. Wakf properties, originally donated for religious, philanthropic, and social purposes, have frequently been misused, illegally controlled, or embroiled in corruption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The recently proposed Wakf Amendment Bill by the government aims to address these shortcomings and bring transparency and fairness to the administration of Wakf properties. Unfortunately, the Bill is being portrayed as a religious issue by some groups, who argue that it targets Islamic institutions. However, this interpretation is far from the truth. The Bill neither targets any religion nor undermines any community&#8217;s rights. Rather, it seeks to protect Wakf properties from misuse and redirect them toward their original objective\u2014public welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Historical Context and Current Challenges of Wakf Properties<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The concept of Wakf in Islam is deeply rooted in charity and social service, primarily aimed at helping the poor, orphans, widows, and the needy. In early Islamic history, Wakf assets were used for education, healthcare, and public welfare. However, over time, administrative control over these properties grew, and personal interests began to influence their management, leading to widespread misuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Wakf Act of 1995 in India gave Wakf Boards several powers intended to protect and manage Wakf properties. In practice, however, many boards have acted arbitrarily, leading to disputes and a complete lack of transparency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Key Problems Faced by Wakf Boards Today:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Declaring properties as Wakf without proper procedure \u2013 often, private or institutional lands are wrongly classified as Wakf properties without solid evidence, sparking legal conflicts.<\/li>\n\n\n\n<li>Lack of accurate property records \u2013 with thousands of Wakf properties across India, there is no centralized record, and many have been illegally encroached upon.<\/li>\n\n\n\n<li>Lack of judicial recourse \u2013 the Wakf Act grants vast powers to boards, often denying justice to those affected.<\/li>\n\n\n\n<li>Lack of administrative transparency \u2013 complaints of corruption, fund misuse, and political interference are common.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">To tackle these issues, the government decided to amend the Wakf Act, ensuring better utilization of properties and increased legal transparency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Key Provisions and Benefits of the Wakf Amendment Bill<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Mandatory Verification of Properties<\/strong>\n<ul class=\"wp-block-list\">\n<li>Earlier, Wakf Boards could declare any property as Wakf, even amid ownership disputes. It does not interfere with any religious practices or institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the government&#8217;s duty to prevent misuse of public assets, promote transparency, and strengthen the judiciary. Supporting this Bill means supporting the rule of law and safeguarding public interest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Conclusion: Beyond Religion \u2013 A Need for Administrative Reform<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Wakf Amendment Bill is not anti-religious or anti-community. It is a reform-driven initiative designed to ensure better management and judicial oversight of Wakf properties. Rather than viewing it through a religious lens, it is vital to understand its real purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now is the time to separate religion from administration and move toward a more impartial legal system.
